Privacy Policy of match2blue U.S., Inc. as of November 6, 2008 (no prior versions)

match2blue is a Delaware corporation headquartered in California supplying and maintaining ad hoc networking software in the U.S. for use on mobile devices supported by mobile service carriers and using short messaging service protocols for local messaging (ad hoc networking). It has adopted this privacy policy for information of users of the match2blue software and services and including also visitors to its website www.match2blue.com (all referred to herein as "You"). This policy is part of the binding agreement between match2blue and users of its software of services as stated in its Terms of Service.

1. Collection of Your Personally Identifiable Information
(a) match2blue collects a user profile consisting of personal and contact information, such as your name, gender, age, email address, phone number and identification of your type of mobile device and communications carrier and state of residence as a condition of match2blue software download and/or services from match2blue (profile fields are subject to change). match2blue also collects other profile information, such as your interest groups and any other information included in your profile. If you access a paid service of match2blue financial information will be collected. Then match2blue will maintain a record of revenue generating activity. match2blue may also maintain a record of your inquiries to match2blue , receipt of patches and upgrades to match2blue software by you and all or parts of your postal and residence and business address information with your consent.

(b) match2blue and/or its sponsors may also contact you and seek to collect other information you may then elect to provide. If sponsors of match2blue contact you via match2blue they will announce their own privacy policies to you and those will govern your interactions with them. Similarly, your interactions with your mobile device or mobile communications service providers will be governed by their privacy policies.

(c) match2blue may also create, collect, use and disclose aggregate information that is not personally identifiable, through collation/analysis of the personally identifiable information.


2. Use and Disclosure of Personally Identifiable Information by match2blue

(a) match2blue may use and disclose personally identifiable information or conduct business activity related to services it provides to you, including disclosure to sponsors for their use. Such sponsors can be categorized as marketing partners and other organizations with an interest in such information. match2blue may sometimes disclose personally identifiable information about you to its affiliates or to others who work for it and to its outside auditors, professional advisors, service providers and vendors, potential business merger, acquisition, or sale partners, sponsors and regulators. If match2blue (or any affiliate) enters into a merger, acquisition, or sale of all or a portion of its assets, or stock, users’ personally identifiable information will, in most instances, be one of the items transferred as part of the transaction or pre-transaction due diligence investigation. match2blue may also use or disclose personally identifiable information about you without your consent to protect its customers, employees, or property, in emergency situations and to enforce match2blue rights under its Terms of Service and policies, in court or elsewhere and as otherwise permitted by law.

(b) match2blue may also use and disclose information about you in non-personally identifiable or aggregate formats, such as ratings surveys and service usage and other statistical reports, which do not personally identify you.

(c) match2blue does not ordinarily undertake to access or control your messaging to, from and within ad hoc networks or your messaging to or from your mobile service provider or their uses of such personally identifiable information as you provide to them, but may undertake access or control in case of actual or threatened breach of match2blue Terms of Service obligations or of your other legal obligations or other abusive use of mb2 software of services.


3. Customer Access and Contact

(a) You may examine and correct, if necessary, the personally identifiable information regarding you that is collected and maintained by match2blue in its regular business records. match2blue will correct its records if you make a reasonable showing that any of the personally identifiable information it has collected about you is inaccurate. You may arrange to examine the records containing your personally identifiable information by contacting match2blue via its website www.match2blue.com or company phone line at 415-848-2330, giving it a reasonable period of time to locate and, if necessary, prepare the information for review. You will only be permitted to examine records that contain personally identifiable information about your account and no other account. Your access is subject to reasonable checks of your identity. match2blue reserves the right to charge you for the cost of retrieving and producing any documents or information that you request.

(b) match2blue may send a welcome email and, from time-to-time, other information to users of its software or services and may also send service-related announcements to you. match2blue reserves the right to send you promotional or commercial e-mail as permitted by applicable law and to enable its sponsors to do so. You can manage the promotional or commercial e-mails by following the instructions contained in the e-mails.


4. Report of Privacy Rights Violation

If you believe that you have been aggrieved as to privacy rights by any act of match2blue you are encouraged to contact match2blue directly in order to resolve your question or concerns. match2blue will attempt to reach you to report if any hacking or other intrusion or breach of its security procedures has exposed your personally identifiable information to possible uses other than as permitted in this privacy policy. While mmatch2blue uses reasonable protective measures it does not guarantee security of the personally identifiable information it acquires and maintains.


5. Effective Date, Changes of Privacy Policy

This privacy policy takes effect on November 6, 2008. match2blue may modify this privacy policy at any time and, at its option notify you of any material changes through posting on its website www.match2blue and, at its option, written, electronic, or other means and as otherwise permitted by law. If you find the changes to this policy unacceptable, you have the right to cancel any services and stop using any software provided by match2blue. If you continue to use match2blue's software or services following notice of the changes, that will be your acceptance of and consent to the changes in the revised privacy policy. This includes your consent for any personally identifiable information that match2blue may collect and use and/or disclose starting on the effective date of the revised privacy policy, as well as for any personally identifiable information that match2blue collected prior to the effective date of the revised notice that is thereafter used and/or disclosed consistent with the revised privacy policy.
